The Fourth ACPAA-JETRO Seminar on Design held in Beijing. ACPAA（All China Patent Attorneys Association） and JETRO（Japan External Trade Organization） held Seminar on Design since 2009, on which examiners and patent attorneys from both countries exchanges ideas and information about Design system in respective country. Over 170 representatives from both countries participated in this seminar. Wang Xiaohui，deputy director of Re-examination Board, Mr. Iwasaki Susumu , director of international department of Japan Patent Office, and Li Jianrong, Secretary General of ACPAA delivered the opening remarks at the beginning of the seminar, who expressed their wishes and warmly welcome to all the representatives.
During the seminar, Jia Haiyan, deputy director of Design Examination Department from SIPO(the State Intellectual Property Office) elaborated the regulations and cases about similar application for Design, as well as the examples in the evaluation report on patent rights for Design. Besides, he also gave a brief introduction to some hot topics about intellectual property in China, such as the feasibility of having access to The Hague Agreement concerning the International Deposit of Industrial Designs, protection of graphic interface, incorporating character into the protection scope of Design and etc. What Mr. Jia Haiyan explained clearly displayed a general structure for recent development for Design in China, impressed most of the attendees. In the following stage, Ms. Kimura Kyoko, Director of Mechanics Examination department of Examination Affairs Department in Japan Patent Office, introduced recent development of Design system in Japan, the presentation method for Partial Design, Related Design and multiple figures, the examination of Designs including displaying image and characters, what she said triggered a heated discussion among the examiners and patent attorneys from both associations ; Mr. Xu qing ping, assistant to director of Design Appeals unit of Patent Re-examination Board of SIPO(the State Intellectual Property Office), explained the regulations and related cases relating to "distinctive difference means creativity” which is defined in the second paragraph of article 26 of the Patent Law, deliberately expounded the meaning from the prospective of an examiner; Then Mr. Jiang Ying, vice presiding judge from intellectual property tribunal of Beijing NO.1 Intermediate People's Court, introduced the judging method of infringement through some typical infringement cases which are related to Design. Speakers delivered their presentations in a vivid way and discussed some focus topics in IP fields, which was greatly impressed to all the representatives on the seminar.
The Fourth ACPAA – JETRO Seminar on Design ended with the applause and praise of representatives from both associations, all the representatives share their ideas and wisdom about IP issues around Design with us, enlightening the mind and tapping the thought, which plays an important role in communication between ACPAA and JETRO, and lays a good foundation for future cooperation.
